Policy and Notice of Nondiscrimination on the Basis of Handicapped Status
Including Equal Employment Opportunity (EEO) Plan and Statement

Policy Statement:
 In accordance with Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act (ADA), the City of Nordheim does not discriminate on the basis of handicapped status in the admission or access to, or treatment or employment in, its federally assisted programs or activities.

The City of Nordheim also affirms its commitment to Equal Employment Opportunity (EEO) in compliance with Title VII of the Civil Rights Act of 1964, Executive Order 11246, and other applicable federal and state laws. Employment decisions will be made without regard to race, color, religion, sex, national origin, age, disability, or any other protected characteristic.

Reasonable Accommodation:
 The City will provide reasonable accommodations to qualified individuals with disabilities upon request, to ensure equal access and participation in programs and employment opportunities.

Section 504 Grievance Procedures
Effective Date: 06/30/2025

In accordance with Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act (ADA), the City of Nordheim has adopted the following grievance procedure for prompt and equitable resolution of complaints alleging any action prohibited by these laws.

1. Purpose

This procedure is established to ensure that no qualified individual with a disability is excluded from participation in, denied the benefits of, or subjected to discrimination under any program or activity conducted by the City of Nordheim.

2. Civil Rights Coordinator

The City Clerk has been designated as the Section 504/ADA Coordinator to handle complaints and ensure compliance.

3. Filing a Complaint

A grievance must be filed in writing and contain:

  • The name, address, and contact information of the person filing the complaint;
  • A description of the alleged discriminatory action;
  • The date and location of the alleged incident;
  • The name(s) of individuals involved, if known.

Deadline: Complaints must be submitted within 60 calendar days of the alleged incident.

Complaints can be submitted by email, mail, or in person to the Civil Rights Coordinator.

4. Investigation Process

Upon receipt of a complaint, the City Clerk will:

  1. Acknowledge receipt in writing within 5 business days;
  2. Begin an informal investigation to determine the validity and scope of the complaint;
  3. Allow all parties to submit relevant evidence and information;
  4. Issue a written decision within 30 calendar days of receiving the complaint, including any corrective actions.

If additional time is needed, the complainant will be notified in writing with a revised timeline.

5. Appeal Procedure

If the complainant is not satisfied with the decision, they may file a written appeal to the Mayor within 15 calendar days of the decision. The Mayor or a designated representative will review the appeal and issue a final written response within 30 calendar days.

6. Record Retention

All documentation related to the grievance, including correspondence and findings, shall be retained by the City for a minimum of five (5) years.

7. Non-Retaliation

Retaliation against anyone who files a grievance or cooperates in an investigation is strictly prohibited. Such actions will be addressed as a separate violation.
